Application Problems Of Commercial Speech Doctrine In CIS Countries: On The Example Of Russia And Uzbekistan

Khodjaev Bakhshillo Kamolovich

Read Abstract

This article analyzes the application of the Commercial Speech Doctrine in CIS countries such as
Russian and Uzbekistan. The article shows that the commercial speech doctrine was implemented as
a constitutional principle of information freedom; however Federal Advertising law of Russia gives
priority to the public health rather than commercial speech protection. The article concludes that, in
CIS countries, especially in Uzbekistan and Russia, the government interest to control commercial
information flow has become superior to that of competitor and consumer interests. The presence of
strict legal standards in those countries causes unreasonable government interference in free
commercial speech of advertisers and restricts the flow of commercial information. Therefore, they
are unnecessary and excessive to proper regulation of misleading advertising. Hence, the main
principle of the commercial speech doctrine on the limitation of government intervention does not
work in practice.

Development Of Creativity Skills In Writing, As An Important Tool For Expressing Thoughts (With The Examples From Korean Material)

Tatyana Sergeevna Kim

Read Abstract

Information technology is developing day by day, but at the same time, learning activities directly
related to individual values and ethical issues are practically excluded from the curriculum. Writing
ethics should not be seen only as part of the educational content presented in the curriculum, but
should be practiced more extensively, viewed as an integral part of complex thinking, social and
personal ethics.
When teaching writing in Korean, the emphasis is on the fact that the written text has special
differences, its own special grammatical constructions, endings and vocabulary.
Korean scholars have conducted a study, the results of which showed that the development of skills
in working with the written test has a significant impact on student performance. The authors argue
that by developing certain "guiding questions", students' writing skills can be significantly improved.

Sociolinguistic Analysis Of Court Speech

Dilora Abduhamidovna Nabiyeva, Khurmatillo Tolqinjon Ogli Ismailov

Read Abstract

This article discusses and illuminates the sociolinguistic analysis of Court Speech. Language and
thinking, language and society, language and culture relations today are engaged in the study of
problems in linguistics, such as psycholinguistics, sociolinguistics, pragmalinguistics, lingvocultrology,
cognitive linguistics and their interdependent relationship. Unlike systemic linguistics, the fact that
speech activity is the most important object of linguistic research, which has become a prelude to new
perspectives, new interpretations, leads to the emergence of topical scientific problems and views as
linguistics develops. In this sense, the study of the speech phenomena of linguistic units in linguistics
in the sociolinguistic direction, the study of the state of speech in relation to social status, provided an
opportunity to conduct sociolinguistic research in Uzbek linguistics. According to Professor
Mahmudov, the direction of sociolinguistics in world linguistics, or rather the science, has emerged as
a result of a comprehensive understanding of the strong connection between language and society,
the understanding of the many intersecting points of linguistics and sociology [1. 13]. The above issues

The Dilemma Of International Humanitarian Law: What And How It Protects

Zhema Shishi PhD, Ochoga Edwin Ochoga

Read Abstract

Basically the International Humanitarian Law regime is to prevent armed conflicts and war crime,
considering the catastrophic effects of wars generally. This laudable objective clearly underscored
the kind of optimism most states expressed on this noble cause. In the contrary, a study of
International Humanitarian Law regime over the years has left scholars more critical. This has led to
divergent views about who it protects and how. While some studies questioned its evolution to be
Eurocentric, some others faulted it to be unviable, non-coercive and unenforceable. This paper
constitutes a scholarship on these studies and it contends that, the international humanitarian law is
a branch of public international law that deals with humanitarian interventions in wartime and war
crimes. The legal framework of the international humanitarian law is rooted in the Geneva
Conventions of 1949. The missing link is that, the critics of the international humanitarian law based
their argument on the operations of the judicial organ of the international humanitarian law, the
International Criminal Court. The critics had seen the Court as a coercive tool in the hands of the
western countries to witch-hunt African leaders. However, the operations of the Court should not be
used as a premise to diminish the legality of the law to protect its legal personality as provided for in
the Conventions. And it does not in any way invalidate the international humanitarian law of being
law. This is the angle that this paper stands differently from the previous studies.
