The article examines expert viewpoints as well as views and ideas presented in the scientific literature regarding the qualification of the instigator's action in crimes committed in complicity. It has been discovered through the practice of judicial investigations that there are various approaches to establishing the liability for the instigator’s actions in crimes committed with complicity, and proposals aimed at eliminating them have been developed.

Additionally, expert opinions on the legal character of the initiator were examined and proposals and recommendations for the definition of the scope of liability were developed.
